Agreement to These Terms

Welcome to the website and services of Actually Cute Customs LLC, a custom products studio located at 382 W Parkway Dr, Kaysville, Utah 84037-6897, United States. These Terms of Service form a legal agreement between you and Actually Cute Customs LLC.

By browsing our website, contacting our studio, requesting a quote or placing an order, you agree to be bound by these terms. If you do not agree with any part of these terms, please do not use our website or our services.

The developer CuteCustoms operates this website and the related services. Please read these terms carefully before you place an order. We may ask you to confirm your agreement before we begin work on your project.

About Actually Cute Customs LLC

Actually Cute Customs LLC is a professional, scientific and technical services studio focused on custom products and personalized gifts. We design and handcraft custom apparel, personalized gifts, custom accessories, home and event decor, monogramming, embroidery and bulk corporate orders.

Our studio is based in Kaysville, Utah, and we serve customers across the United States and beyond. Every product we make begins with an idea from you and ends with a finished piece made by our hands.

Our work sits in the custom products and computer integrated systems design space, which means we bring careful planning, precise artwork and thoughtful craftsmanship to every project. Our goal is simple: to make custom products that are cute, durable and loved by the people who receive them.

Eligibility to Use Our Services

Our services are intended for individuals who are at least eighteen years old or the age of majority in their region. If you are younger than eighteen, you may use our services only with the involvement and consent of a parent or guardian.

A parent or guardian who places an order on behalf of a young person is responsible for the order and for these terms. You agree to provide true, accurate and complete information when you use our services.

You agree not to misrepresent your identity or your relationship to an order. You also agree to keep your account and contact details up to date so we can reach you about your order. We reserve the right to refuse service to anyone for lawful reasons.

Our Custom Products and Services

We offer a range of custom product services, including custom apparel such as shirts, hoodies, caps and baby onesies; personalized gifts such as mugs, tumblers and keepsake boxes; custom accessories such as bags, hats, keychains and hair accessories; home and event decor such as signs, banners and tableware; monogramming and embroidery; and bulk orders for teams, events and companies.

Every product is made to order, which means your item is created only after you place your order. Because each piece is made for you, slight variations in color, texture and finish are normal and expected.

We describe each product accurately on our website and in our quotes. If a product or a service changes, we will update the description so you always know what you are ordering.

Quotes, Estimates and Orders

Every project starts with a request. You can ask for a quote through our website, by email or by phone. We respond to quote requests with a written estimate that describes the product, the size, the quantity, the personalization and the price.

An estimate is not a contract until we both confirm it. To place an order, you confirm the final design and details with our team. Once we confirm your order, we will send you an order confirmation that summarizes everything we agreed.

Please review your confirmation carefully and tell us about any mistake right away. We cannot accept responsibility for errors that you did not report before production began. Orders are accepted at our studio in Kaysville, Utah.

Pricing and Payment

All prices are listed in United States dollars unless we state otherwise. The price for your custom product is the price shown in your confirmed order. Prices include the base product, the personalization and standard finishing, but they may not include shipping or taxes.

Applicable sales tax will be added where required by law. We accept payment by major credit cards and through our secure payment processor. Payment details are processed by a certified third party, and we do not store your full card number.

Your order is considered paid once our processor confirms the transaction. If a payment fails, we will contact you before we begin production. We may update our prices at any time, but we will honor the price in your confirmed order.

Deposits and Balance Due

Depending on the size and cost of your order, we may ask for a deposit before we begin work. A deposit confirms your commitment to the project and reserves our production time.

The deposit is usually a portion of the total price, and we will tell you the exact amount before you pay. The remaining balance is due before your order is shipped or at pickup, unless we agree on a different schedule.

If we customize the deposit terms for your project, those terms will be written in your order confirmation. We do not begin production until any required deposit is paid. If you cancel a project after production begins, the deposit may not be refundable because we have already committed materials and time to your order.

Design and Artwork Process

Custom products begin with a design. You provide the idea, the message or the artwork, and our team helps you turn it into a production ready design. We offer design help for customers who need guidance.

You may upload files, send photos or describe what you want in your order notes. We review your materials and produce a design proof for your approval. The proof shows the placement, colors and sizes of your personalization.

We do our best to match your vision, but we cannot guarantee that every description will be reproduced exactly. Complex designs may require more proof rounds, and significant changes after approval may affect your price or your delivery date. Our design team communicates with you in plain language at every step.

Approval of Designs

Before production begins, we send you a design proof for approval. Production starts only after you approve the proof, either by email or by confirming through our team.

Once you approve, that approval is final for the layout, colors and text on your order. Please check the spelling, the dates, the names and the details carefully at proof stage. We print and embroider exactly what is approved, so a mistake in an approved proof is the responsibility of the customer.

If you notice an error after production begins, please tell us right away. We will always try to help, but corrections after production may require a new order and additional cost. We recommend that every customer review their proof slowly and carefully.

Production and Turnaround

Every custom product is made by hand, which takes time and care. Our standard turnaround is shown in our quotes and in the gift comparison table on our website.

Apparel generally takes five to seven days, personalized gifts take three to five days, and accessories take seven to ten days. Turnaround time begins after we approve the final design and receive any required deposit.

Busy seasons, such as the winter holidays and graduation months, may extend turnaround times. We do our best to meet the dates we promise, and we will tell you promptly if your order will be late. If you need a product by a specific date, let us know at the time you order. We may be able to offer rush service for an additional fee.

Shipping and Delivery

We ship custom products across the United States and, in many cases, internationally. Shipping options, costs and estimated delivery times are shown at checkout or in your order confirmation.

We pack every order with care, wrapping custom products in tissue and finishing them with ribbon so they arrive ready to gift. Delivery times depend on the carrier and the destination, and they begin after your order leaves our studio.

We are not responsible for delays caused by carriers, weather or customs. If your package arrives damaged, please take photos and contact us within a few days so we can help. If an address is wrong, we will do our best to help, but additional shipping costs may apply. We may also offer local pickup in Kaysville, Utah.

Returns, Refunds and Exchanges

Because every custom product is made just for you, standard returns do not apply in most cases. Custom items are final sale once produced correctly.

If your product arrives damaged, defective or incorrect due to our error, we will fix it or remake it at no cost to you. If we cannot fix or remake the product, we will offer a refund.

To request help, contact us within seven days of delivery with photos and a description of the issue. Refunds are processed to the original payment method once we confirm the issue. We do not accept returns for items that were approved in proof and produced correctly. Please contact us with any concern, and our team will treat you fairly.

Product Disclaimers and Care

Custom products are made from materials that can vary slightly from piece to piece. Colors may look different on your screen than in person. Fabrics, mugs and accessories may show subtle differences in tone and texture. This is part of the charm of handmade goods, and it is not a defect.

To keep your custom products looking great, follow the care instructions included with your order. Most apparel should be washed inside out in cold water and laid flat to dry. Mugs and tumblers should be washed by hand. Embroidery and monograms should be handled with care.

We cannot be responsible for damage caused by improper care. We describe materials and finishes honestly so you can make an informed choice before you order.

Intellectual Property

Actually Cute Customs LLC owns the rights to our website, our original designs, our templates, our photos and our brand. You may not copy, reuse or resell our original artwork without our written permission.

When we create an original design for you, we transfer the rights to that finished design to you for the intended product, but we keep the right to show the work in our portfolio.

We respect the intellectual property of others. If you believe something on our website infringes your rights, please contact us and we will review your claim promptly. We do not knowingly reproduce trademarks, logos or copyrighted artwork without permission. If you provide branded content for your order, you confirm that you have the right to use it.

Client Materials and License

When you send us artwork, photos, logos or messages for personalization, you keep the rights to your materials. By sending us these materials, you give us a license to use them for your order: to reproduce, print, embroider or apply them to your products, and to store them while we work on your project.

This license ends when your order is complete and your materials are no longer needed. You confirm that your materials do not violate any law or the rights of any third party.

We are not responsible for designs that infringe the rights of another person. If your materials contain a trademark or a logo, you confirm that you own it or have permission to use it. Please do not send us anything you do not have the right to use.

Your Responsibilities

You are responsible for the accuracy of the information you give us. Please double check your spelling, your addresses and your personalization text before you approve your order.

You are responsible for reading and understanding these terms. You are responsible for keeping your contact details current so we can reach you. You are responsible for paying the agreed price for your order.

You are also responsible for using our products lawfully. If you provide content that violates the law or the rights of others, you accept responsibility for that content. We rely on the information you provide to make your products correctly. A little care on your side prevents a lot of problems later. If you have any doubt about an instruction, please ask us before you confirm.

Acceptable Use

When you use our website and services, you agree to behave lawfully and respectfully. You may not misuse our website, attempt to break its security or interfere with its operation.

You may not upload content that is unlawful, offensive, deceptive or infringing. You may not request products that are illegal or that harm others. You may not resell our services without our permission. You may not use our website to collect information about others without their consent.

You may not pretend to be another person or another business. We may refuse or cancel orders that violate these rules. We may remove content that violates these rules. If we believe your use of our services is harmful or unlawful, we may suspend or terminate that use and, where appropriate, report it to the authorities.

Limitation of Liability

To the maximum extent allowed by law, Actually Cute Customs LLC is not liable for indirect, incidental, special or consequential damages arising from your use of our website or services. This includes lost profits, lost data, lost business opportunities and emotional distress.

Our total liability for any claim related to an order is limited to the amount you paid for that order. This limitation applies whether the claim is based on contract, warranty, tort or any other legal theory.

Some regions do not allow certain limitations, so some of these limits may not apply to you. Nothing in these terms limits our liability for fraud, gross negligence or harm caused intentionally. We are a small studio and we stand behind our work, but we cannot be responsible for outcomes beyond our control, such as carrier delays or screen color differences.

Indemnification

You agree to indemnify and hold harmless Actually Cute Customs LLC, the developer CuteCustoms and our team from any claims, damages, losses or expenses that arise from your use of our services.

This includes claims that content you provided infringes the rights of a third party, claims that your use of our products was unlawful, and claims arising from your breach of these terms.

We will notify you of any claim where reasonably possible. You agree to cooperate with us in defending such claims. You also agree that you are responsible for your own conduct when using our website and services. This indemnification survives the end of your relationship with us. If you are unsure whether something you plan to do is lawful, please ask us or seek professional advice before you proceed.

Governing Law and Jurisdiction

These terms are governed by the laws of the state of Utah and the federal laws of the United States, without regard to conflict of law rules. Our studio is located in Kaysville, Utah.

Any dispute that is not resolved informally will be brought exclusively in the state or federal courts located in Utah. You agree to submit to the personal jurisdiction of those courts for the purpose of any such dispute.

This clause does not limit your rights under mandatory consumer protection laws in your region. If you live outside the United States, you may also have rights under the laws of your own country. We will always seek to resolve disagreements fairly and directly with you before any formal action. Good communication resolves most issues before they become disputes.

Dispute Resolution

We hope that every order brings joy, but if a problem arises, we want to fix it. Before any formal action, please contact us directly so we can understand the issue and find a fair solution.

Most concerns are resolved by a remake, a repair or a refund. If we cannot resolve the matter informally, we will follow the process set out in law. You may choose to resolve a dispute in a small claims court that has jurisdiction, where such a process is available.

You agree that, to the extent permitted by law, any dispute will be resolved on an individual basis and not through a class action. Any arbitration, where required, will be held in Utah. We will always be reasonable and transparent about how we resolve disputes. Your statutory rights under consumer law are never removed by this section.

Changes to These Terms

We may update these Terms of Service from time to time. When we make changes, we will post the updated terms on this page and update the effective date.

If the changes are significant, we will add a notice on our homepage and, where appropriate, contact you by email. Continued use of our website or services after the changes take effect means you accept the updated terms.

Changes do not apply to orders that were already confirmed before the change took effect, unless the law requires otherwise. We encourage you to review these terms whenever you use our website. Older versions of the terms are available on request. We will never change these terms in a way that unfairly takes away your rights without telling you clearly.

Severability and Waiver

If any part of these terms is found to be unlawful or unenforceable, that part will be limited or removed, and the rest of the terms will remain in full effect.

Our failure to enforce any part of these terms is not a waiver of our right to enforce it later. A waiver is effective only if it is in writing and signed by us. We may delay enforcing our rights without losing them.

The headings in these terms are for convenience only and do not change the meaning of the terms. This section keeps the terms balanced and workable. If a court changes one clause, the other clauses still stand. You and we both intend these terms to be read as a whole.

Entire Agreement

These terms, together with your order confirmation and our quotes, form the entire agreement between you and Actually Cute Customs LLC about your custom products. They replace any earlier agreements, promises or communications about the same subject, whether written or verbal.

Anything we say in our website content, emails or conversations does not create additional rights unless we put it in writing in your order confirmation. If there is a conflict between these terms and an order confirmation, the order confirmation controls for that specific order.

You may not transfer your rights or obligations under these terms without our permission. We may transfer our rights and obligations to an affiliate or successor. This section makes sure we are all working from the same understanding.
